
General Terms and Conditions
§ 1 Scope of application
(1) These General Terms and Conditions (hereinafter “GTC”) apply to contracts between Pompadour Exclusive Salon & Spa, Neugasse 15, 07743 Jena (Owner: Bernd Funke) and its service recipients (hereinafter “Customers”).
(2) The GTC apply regardless of whether the customer is a consumer, entrepreneur or
merchant.
(3) The version of the GTC valid at the time of the contract conclusion shall apply.
(4) Deviating conditions of the customer are not accepted. This also applies if
the inclusion is not expressly objected to.
§ 2 Contract Conclusion / Appointments / Cancellation
(1) With reservation of the appointment, a service contract arises between the customer and Pompadour Exclusive Salon & Spa.
(2) An individually tailored care ritual for hair, scalp and soul takes time.
Therefore, Pompadour Exclusive Salon & Spa works customer-oriented and exclusively on an appointment basis. An appointment can be arranged by the customer on site, by telephone or via the booking tool on the homepage https://www.pompadourjena.de/kontakt.
(3) If the customer cannot keep an appointment agreed in accordance with § 2 para. (2),
the appointment must be canceled at the latest 48h (working days) in advance, either by telephone, online using the booking tool (https://www.time-globe-crs.de/crs-online-4145/service) or directly at the salon.
(4) In the event of later cancellations or failure to appear at the appointment or significantly delayed
appearance of the customer at the appointment, Pompadour Exclusive Salon & Spa is entitled to demand the remuneration of the intended service minus any saved expenses.
(5) The compensation for cancellation according to § 2 para. (4) corresponds, taking into account saved expenses, to 90 % of the estimated price of the intended service, but at least 50 EUR for adults and adolescents (from the 13th year of age) and 20 EUR for children (up to the completion of the 12th year of age).
(6) For certain services (e.g. weddings), there is a pre-payment obligation of the customer. This will be communicated to the customer when arranging the appointment. If the customer does not fulfill this obligation up to 48h (working days) before the appointment, Pompadour Exclusive Salon & Spa is entitled to terminate the contractual relationship and assign the appointment elsewhere.
§ 3 Prices
(1) The current price list can be viewed at https://www.pompadour-jena.de or directly in the displays of the salon. All prices include the respective statutory value added tax.
(2) Services that are not subject to the price list are communicated in advance by the employees of Pompadour Exclusive Salon & Spa.
§ 4 Vouchers
(1) At Pompadour Exclusive Salon & Spa, the customer can purchase value or service vouchers as a gift for third parties.
(2) As a special sign of appreciation or in the course of promotions, Pompadour Exclusive Salon & Spa also offers its own value and promotional vouchers. These vouchers are tied to the respective recipient. A transfer to third parties is excluded.
(3) The validity period of the vouchers is governed by the provisions of the BGB.
§ 4 Vouchers

§ 5 Warranty
(1) Any defects in the services of Pompadour Exclusive Salon & Spa must be reported within 3 working days. In the event of timely notification of defects, the customer has a right to subsequent performance.
(2) The right to subsequent performance is excluded insofar as the defect is insignificant. This applies in particular to only minor deviations from the agreed service or condition, natural wear and tear, and damage caused by treatment, use or unsuitable care by the customer or by external influences.
(3) In the event of premature self-performance, the customer loses any warranty rights for defects.
(4) The warranty for defects of purchased products at Pompadour Exclusive Salon & Spa follows the sales law warranty of the BGB.
§ 6 Other Liability
(1) Pompadour Exclusive Salon & Spa assumes no liability for clothing, bags, luggage or other valuables of customers that they bring into the salon during their stay. This also applies to damage to clothing or jewelry of the customer, unless the damage is caused intentionally or by gross negligence by employees of Pompadour Exclusive Salon & Spa.
(2) If there are any intolerances or allergies with regard to the performance of treatments or the use of certain products, the customer is obliged to point this out before the service is provided. If damage occurs as a result of the omitted notice, liability is also excluded.
(3) Liability is excluded in particular for chemical, thermal, hair cosmetic and hairdressing measures and treatments, including hair extensions, expressly requested by the customer or advised against by employees of Pompadour Exclusive Salon & Spa.
(4) Due to the binding appointment allocation according to § 2 of the GTC, Pompadour Exclusive Salon & Spa strives to start each appointment punctually. Due to unforeseeable events, however, waiting times are possible. Pompadour Exclusive Salon & Spa assumes no liability for this.
(5) The customer is liable for intentionally and negligently caused damage to Pompadour Exclusive Salon & Spa. This applies in particular to violations of § 2 of the GTC.
§ 7 Data Protection Notices
Notes on the processing of the customer's personal data result from the separately defined data protection notices of Pompadour Exclusive Salon & Spa.
§ 8 Severability Clause
The invalidity of individual provisions of the GTC does not affect the validity of the remaining provisions of these GTC.
